TERMS & CONDITIONS – Chic Mama Restaurant, Positano

Welcome to Chic Mama Restaurant.
The use of our services and access to our premises are subject to the following General Terms and Conditions.
By confirming a reservation, making a payment, or accessing the restaurant, you acknowledge and agree to be bound by these terms in their entirety.

1. GENERAL RULES

Package Integrity
Experience packages must be accepted in their entirety. Changes or substitutions are not permitted.
Dietary requirements, allergies, or intolerances communicated at the time of booking will be accommodated where possible.

Non-Consumption Policy
No refunds will be issued for any unused or unconsumed items included in the selected experience.

Prepayment and Credit Use
If the total value of consumed items is lower than the prepaid amount:
– the remaining credit is non-refundable
– it cannot be used at a later time
Any additional items must be paid on-site.

Reservation Validity
Reservations are valid only after receiving the official confirmation email.

Late Arrival and No-Show
Reservations are held for up to 30 minutes after the scheduled time, unless otherwise communicated in advance.
After this period:
– the reservation is considered a no-show
– no refund or rescheduling will be granted

2. ARRIVAL CONDITIONS

Independent Arrival
The reservation time is binding. Failure to arrive within 30 minutes without prior communication will result in a no-show.

Shuttle Arrival
A no-show will only be recorded if guests are not present at the meeting point and no communication has been received.
If guests are on board the shuttle, the reservation remains valid.

Delays
If a delay is communicated in advance, we will attempt to accommodate based on availability.
If not communicated, the standard no-show policy applies.

3. BOOKING RATES

Reservation Guarantee (No-Show Policy)
No prepayment is required. The reservation is secured via credit card authorization.
Free cancellation is allowed up to 72 hours before the reservation time.
In case of late cancellation, no-show, or reduction in number of guests, a penalty of €{{isp_guaranteed_refund}} per person will be charged to the payment method provided at the time of booking.
The guest expressly authorizes this charge at the time of booking.

Prepaid Non-Refundable Rate
Full payment is required at booking and charged immediately.
This rate is strictly non-refundable.
In case of cancellation, no-show, or reduction in number of guests, no refund will be issued.
One date change may be allowed subject to availability.
Any price difference must be paid. Remaining credit is not refundable.

Prepaid Refundable Rate
Full payment is required at booking.
Free cancellation is allowed up to 5 days before the reservation date.
After this period, the reservation becomes non-refundable.
Rescheduling is allowed within the same timeframe, subject to availability and price differences.

Last Minute Rate
Reservations are paid at booking and cannot be modified or cancelled.
In case of cancellation, 100% of the total amount will be charged.

Non-Prepaid Experiences
No payment is required at booking.
The reservation must be reconfirmed 3 days before and on the day of the reservation.
If no response is received, the reservation may be cancelled.

4. RESTAURANT POLICY

Outside food and beverages are not permitted.
Each guest is assigned a personal seat and dining experience.
Reservations are personal and non-transferable unless communicated in advance.
Delays must be communicated in advance.
Management reserves the right to deny access in case of inappropriate behavior.
Opening hours: 18:00 to last seating at 22:00.
Guests may remain on the premises after dining in designated areas.
Pets are not allowed.

5. CHILDREN POLICY

Children aged 2–17 are considered part of the “Children” category.
A dedicated menu may be available and will be charged separately as an extra.

6. SHUTTLE SERVICE (FREE CLAUSE)

The shuttle service is complimentary, ancillary, and not part of the purchased services.
It must be requested during booking and may take up to 40 minutes depending on traffic.
The service is shared with other guests.

Guests must arrive on time at the meeting point.
The shuttle departs punctually. Late arrival may result in loss of service.
Return transfer must be requested at least 15 minutes in advance.

The service may be modified or suspended due to operational or safety reasons.
Guests are responsible for reaching the restaurant independently if the shuttle is unavailable.
No refund or compensation applies.

7. WEATHER POLICY

The restaurant remains operational in non-dangerous weather conditions.
The experience remains valid and no refunds will be issued.

8. CLOSURE AND FORCE MAJEURE

In case of closure due to extreme weather, natural disasters, public restrictions, or force majeure events:
Management may reschedule the reservation or convert it into a non-refundable credit valid for 12 months.
There is no obligation for monetary refund.

9. MANAGEMENT OF RESERVATIONS IN CASE OF CLOSURE

If rescheduling is not possible, the reservation will be converted into credit valid for 12 months.
The credit can be used for Chic Mama Restaurant, New Opening Restaurant, YachtCellar.com, and Arienzo Beach Club online shop.
If no response is received within 72 hours, the reservation will be automatically converted into credit.

10. COMMUNICATIONS

Guests agree to receive communications via email, SMS, or WhatsApp.
Failure to receive communications does not entitle to refunds or compensation.

11. NON-CONTESTABILITY CLAUSE

Management decisions regarding closure, rescheduling, or credit conversion are final, binding, and not subject to dispute.

12. DOCUMENT VALIDITY

The latest version published on the official website at the time of booking prevails.
